Thank you for using Upstream.life!

These Terms of Use (“Terms”) govern your access to and use of the Upstream.life learning portal, including the courses, learning materials, features, communications, and related services made available through it (collectively, the “Portal”).

The Portal is operated by Oleh Anatoliiovych Bokov, an individual entrepreneur duly registered under the laws of Ukraine, email: biblecourse@upstream.life (“Upstream,” “we,” “us,” or “our”).
The technical infrastructure of the Portal is provided through the Clevio educational platform, owned by LLC “DV Digital Media.” LLC “DV Digital Media” provides access to the software, technical support, and maintenance on behalf of Upstream. Unless expressly stated otherwise, Clevio and LLC “DV Digital Media” are not providers of educational content, organisers of training, or parties to these Terms.
By creating an account, accessing the Portal, or using it, you confirm that you have read and agree to these Terms, the Upstream.life Privacy Policy, the Cookie Policy, and the terms of a specific programme, if they are made available to you before the start of your learning.
If you do not agree to these Terms, do not use the Portal.

1. Purpose and Availability of the Portal

Upstream.life is an online learning environment. The Portal may include courses, lessons, videos, texts, assignments, tests, downloadable materials, discussions, certificates, notifications, and other educational features.

The range of available materials and features may depend on your programme, registration, payment status, access through a partner organisation, country of residence, technical conditions, and other applicable criteria.
We may update, modify, restrict, or discontinue certain Portal features where reasonably necessary for maintenance, security, legal compliance, service development, or the improvement of learning. Where possible, we will notify you in advance of material changes affecting access you have already purchased.

2. Account and Age Requirements

You may use the Portal only if you have the legal capacity to enter into legally binding agreements under applicable law.

If you have not reached the age at which you may independently consent to the processing of personal data or enter into an agreement under the laws of your country, access to the Portal is permitted only with the consent of a parent, legal representative, school, church, employer, or another authorised organisation, where required by law.
When registering for and using an account, you agree to:

provide accurate, current, and complete information;

not share your username, password, verification code, or account access with third parties;

promptly notify us at biblecourse@upstream.life if you suspect unauthorised access;

not use another person’s account without their explicit permission and a lawful basis;

update your information in a timely manner if it becomes inaccurate.

You are responsible for actions taken through your account, except where those actions result from a security breach caused by us.

If access to the Portal is provided by a school, church, employer, ministry, or partner organisation, that organisation may administer your access, assign courses, view learning progress, and terminate enrolment in accordance with its own rules and legal authority.

3. Right to Use

Subject to these Terms, Upstream grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Portal for educational purposes and within the scope of the access granted to you.

This right does not transfer ownership of the Portal, Clevio software, design, learning materials, brand, databases, videos, texts, or any other intellectual property to you.
Without Upstream’s prior written consent, you may not:

copy, reproduce, publish, distribute, sell, rent, lease, or use Portal materials for commercial purposes;

bypass or attempt to bypass security measures, access restrictions, technical mechanisms, or verification procedures;

reverse engineer, decompile, disassemble, or attempt to obtain source code, except where expressly permitted by mandatory law;

use bots, scripts, parsers, mass data collection tools, or other automated means of access without written permission;

interfere with the operation of the Portal, overload it, create security risks, or disrupt the learning of other users.

4. Learning Content and Learning Results

Portal materials are intended for educational purposes. Unless expressly stated otherwise in the description of a specific course, they do not constitute personal legal, medical, financial, psychological, investment, or other professional advice.

We aim to keep the materials useful and up to date, but we do not guarantee that they will be complete, error-free, continuously available, or suitable for every particular situation.
Completing a course, completing an assignment, or receiving a certificate does not in itself guarantee a qualification, employment, increased income, a medical outcome, or any other specific result, unless expressly promised in the description of the relevant programme.

5. Intellectual Property

The Portal, its software, design, interfaces, texts, videos, graphics, logos, learning materials, trademarks, photographs, audio recordings, and other elements belong to Upstream, authors, partners, or other rights holders and are protected by intellectual property laws.

You may use the available materials solely for personal learning through the Portal, unless we provide you with a different right in writing. You may not remove, conceal, or alter copyright notices, trademarks, authorship notices, or other proprietary notices.

6. Materials You Submit

This section applies if the Portal allows you to upload assignments, leave comments, post messages, submit files, reviews, or other materials (“User Content”).

You retain the rights you own in your User Content. By submitting it, you grant Upstream a non-exclusive, worldwide, royalty-free right to store, reproduce, display, process, and use that content to the extent necessary for delivering learning, administration, security, backup, and operation of the Portal.
You confirm that you have the right to submit such content, that it does not infringe third-party rights, and that it does not contain malicious code, unlawful, threatening, discriminatory, offensive, defamatory, or clearly inappropriate materials.
We may remove, hide, or restrict access to User Content where reasonably necessary to protect users, comply with the law, enforce these Terms, or maintain the security of the Portal.

7. Acceptable Use Rules

The Portal must be used lawfully, respectfully, and in accordance with its educational purpose. You must not:

harass, insult, intimidate, humiliate, discriminate against, or harm other persons;

impersonate another person or misrepresent information about your identity, organisation, or authority;

distribute spam, malware, unauthorised advertising, or mass messages;

violate confidentiality, privacy, copyright, or other rights of third parties;

collect personal data of other users without a lawful basis and required permissions;

use the Portal for fraud, unlawful activities, or purposes not permitted by these Terms.

8. Third-Party Services

The Portal may contain links to or integrations with third-party services, such as payment systems, video hosting services, messaging services, CRM systems, calendars, or other tools. These services operate under their own terms and privacy policies. Upstream is not responsible for their content, availability, or practices unless otherwise required by mandatory law.

9. Suspension and Termination of Access

We may temporarily restrict, suspend, or terminate access to the Portal where reasonably necessary, including when:

you have materially breached these Terms;

your use creates a risk to the security of the Portal, other users, or legal compliance;

the organisation through which you received access has terminated your enrolment;

a course, programme, or service is discontinued;

your paid access period has expired or a payment obligation has been breached.

Where possible and appropriate, we will explain the reason and provide a reasonable opportunity to remedy the breach before terminating access.

You may stop using the Portal at any time. To close your account, contact us at biblecourse@upstream.life. Deletion may be carried out subject to legal requirements, data retention periods, the rights of other users, and the rules of the organisation through which access was provided.

10. Changes to the Terms

We may update these Terms in response to changes to the Portal, applicable law, security requirements, or business processes. We will notify you of material changes through the Portal, by email, or through another reasonable method.

The updated version takes effect on the date stated at the end of this document. By continuing to use the Portal after that date, you agree to the updated Terms where such a process is permitted by applicable law.

11. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right does not constitute a waiver of that right in the future.

You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations in connection with a reorganisation, sale of assets, or transfer of the Portal, subject to applicable law.
These Terms, together with the Privacy Policy, Cookie Policy, the terms of specific courses, and payment rules, constitute the entire agreement between you and Upstream regarding use of the Portal.
